eBay is an online marketplace where individuals and businesses list goods by auction or at a fixed price, and where buyers around the world can search and bid. For sellers the platform acts as a sales channel with payment and shipping functions attached; buyers use it through the website and apps. eBay is delivered as a hosted platform; there is no self-hosted option and the source code is not public.
eBay Inc. is headquartered in San Jose, California, and is a US company. According to its privacy notice, the data controller for users in the EU is eBay GmbH in Germany, and payment services for sellers in the EEA run through eBay S.à r.l. in Luxembourg. The notice names no fixed data-centre locations and says recipients may be located anywhere in the world. Because the parent company is American, the US CLOUD Act can apply to data of European sellers and buyers.
