It is a cloud service delivered through Microsoft 365 apps, the Copilot app and Edge.

Microsoft is a US company and the service falls under US law. Microsoft states that prompts, responses and Graph data are not used to train the foundation models, and that EU traffic stays within the EU Data Boundary while worldwide traffic can be processed in the EU and other regions. Models from OpenAI and Anthropic act as subprocessors; Anthropic models are currently excluded from the EU Data Boundary, and administrators decide whether to enable them.
