Google is a US company and subject to US jurisdiction, including the CLOUD Act. Which terms apply depends on the sign-in method: a Google account through Gemini Code Assist, a Gemini API key, or Vertex AI with a Google Cloud project. Business users fall under the Google Cloud terms. The documentation does not state where data is stored or processed, and usage statistics can be switched off. According to the documentation, Gemini CLI has been replaced by Antigravity CLI for free-tier and Google One users. The source code is public, but as long as the models run at Google, prompts and code leave your own environment.
