Azure Kubernetes Service: sovereignty score and 8 European alternatives

Azure Kubernetes Service (AKS) is the managed Kubernetes service of Microsoft Azure. According to the product page, Microsoft handles tasks such as health monitoring and maintenance of the control plane, while the customer manages the agent nodes. The service includes AKS Automatic for automated upgrades and scaling, GitHub Actions integration, monitoring, identity and access management, and Azure Kubernetes Fleet Manager for multiple clusters. With Azure Arc, AKS can also run on your own infrastructure or at the edge.

AKS is provided by Microsoft Corporation, headquartered in the United States, and is therefore subject to US law such as the CLOUD Act. Clusters are regional resources: the AKS FAQ states that all data is stored in the cluster's region, so a European region can be chosen. In its data protection terms for online services Microsoft sets out GDPR processor commitments and uses standard contractual clauses for transfers outside the EEA. Kubernetes itself is open source, which eases moving to other environments, but Azure-specific integrations remain tied to the platform.

Why digital sovereignty matters with Azure Kubernetes Service

Azure Kubernetes Service is headquartered in the United States. US vendors fall under the CLOUD Act and FISA 702: US authorities can compel access to data, even when that data sits in a European data centre. That is the core of the jurisdictional exposure in our model.

Azure Kubernetes Service hosts data in US, EU. Exactly what stays within the EU — and what does not — is defined by the vendor's data processing agreement and sub-processor list, not by a setting you control yourself; check those documents for the precise scope, including backups, logs and support access.

Azure Kubernetes Service is closed source and hosted by the vendor. The encryption keys and the runtime sit with the vendor and switching requires data migration. Ask about bring-your-own-key, export options and open standards.

What this means for your organisation depends on your whole stack and context. The free assessment weighs Azure Kubernetes Service together with your other vendors and gives a total score, a heatmap and the main risk drivers.
