Mailchimp: sovereignty score and 8 European alternatives

Mailchimp is a web-based marketing platform for email campaigns and marketing automation. It offers templates and a drag-and-drop editor, behaviour-triggered automations, audience management with signup forms, segmentation and tags, landing pages, social posting and ads, analytics, and AI-assisted copywriting. It is aimed at small and growing businesses, agencies and nonprofits, with integrations for e-commerce platforms and APIs for developers. Mailchimp is delivered as software as a service through a web account and a mobile app.

Mailchimp has been owned by Intuit Inc. since 2021, and is headquartered in Atlanta, Georgia, in the United States. According to Mailchimp's privacy FAQ, its servers are in US data centres, and the page mentions no EU data-residency option. European personal data is therefore transferred to the US; Mailchimp states that it relies on the EU standard contractual clauses in its Data Processing Addendum. The product is proprietary and cannot be self-hosted. A European organisation should assess these transfers, the exposure to US law and the sub-processor list before placing subscriber data in it.

Why digital sovereignty matters with Mailchimp

Mailchimp is headquartered in the United States. US vendors fall under the CLOUD Act and FISA 702: US authorities can compel access to data, even when that data sits in a European data centre. That is the core of the jurisdictional exposure in our model.

Mailchimp hosts data outside the EU (US). Personal data therefore leaves the EU, which requires a transfer mechanism under the GDPR and pulls the data residency score down.

Mailchimp is closed source and hosted by the vendor. The encryption keys and the runtime sit with the vendor and switching requires data migration. Ask about bring-your-own-key, export options and open standards.

What this means for your organisation depends on your whole stack and context. The free assessment weighs Mailchimp together with your other vendors and gives a total score, a heatmap and the main risk drivers.
